Conditions of participation

The Footprints Panel is a market research portal operated by intervista AG (“intervista”, “we”, “our”, “us”). These conditions govern participation in the Panel, use of the Footprints Research App (the "App", the "Software") and the Project Web Site https://footprints.apps.axinova.ch/ (the "Web Site").

Participation

As a member of the Footprints Panel, location data of your smartphone will be transmitted to intervista at regular intervals for research purposes and you have the opportunity to participate in market research activities, including mobile surveys.

To participate in the Footprints Panel, the app "Footprints Research" must be installed. The app requires access to location data and Bluetooth. You will be invited to short surveys via push notifications and email. In general, you will be informed about the expected duration of the survey and the reward.

Some surveys are aimed at members who are at a specific location or at members with specific characteristics, such as drivers, students or professionals. This means that not all members can participate in all surveys and therefore there is generally no entitlement to participate in certain surveys.

Participation in the panel is of course voluntary and can be terminated at any time. You can unsubscribe by email or simply uninstall the app (in which case you will receive two more emails informing you that no data has been sent for some time).

We reserve the right to terminate your participation at any time and without giving reasons if no data is transmitted for a longer period of time, if you have been inactive for a longer period of time or if you violate these conditions of participation.

Rewards

Once you have installed the app and participated in the research project for one month, you will receive a bonus of 50 intervista bonus points credited directly to your account. You will then receive an additional 20 bonus points for each additional month in which you have installed the app. If we invite you to take part in a survey via the app, you will receive additional bonus points for each survey.

Only members who regularly submit data during a month will receive the reward provided for that month.

Copyright

The copyright to the panel and the software remains solely with intervista.

By becoming a member you acknowledge that all content on this website, the software and the Panel and related surveys, including but not limited to text, sound, images, surveys, software or other materials (collectively, the "Content") are owned by intervista. You may not copy, modify, reproduce, republish, post, transmit, sell, offer for sale or otherwise use such Content in any way without the express permission of intervista.

You must comply with any copyright notices, information, or restrictions contained or attached to such content.

All answers, data and information provided by a member in the course of participating in the Panel as part of a survey or study are the intellectual property of intervista to the extent permitted by applicable law.

Limitation of liability

intervista makes no representations whatsoever, express or implied, about the use of the software, the Panel and/or the website, including but not limited to its merchantability, fitness for a particular purpose, or non-infringement.

The Member agrees that use of the Panel and this Website and/or the software is at the Member's own risk. The Panel and all services offered therein are provided "as is" without warranty of any kind.

In no event shall intervista be liable for any loss or damage of any kind, whether direct, indirect, incidental, consequential or otherwise, arising out of or in connection with the access to or use of the Panel or the inability to access or use the Panel.

Links to external websites (so-called external links) on the website serve as a mere reference to topics which might be helpful for the users of this site. intervista has no control over the content of external links, so intervista assumes no liability for the content of such external links, including their accuracy, completeness, reliability or suitability for specific purposes. Illegal content will be removed immediately upon notification.

intervista reserves the right to change and adapt these conditions at any time.

Should any provision of these Terms of Use be or become invalid in whole or in part, the validity or effectiveness of the remaining provisions shall not be affected thereby. The invalid provisions shall be interpreted or replaced in a legally permissible manner in accordance with the intended economic purpose.
